Update on BIA decision

The Board decided that “their interpretation of the Chancellor’s ruling was different than our lawyer’s interpretation.”  They recommended that it be sent back to the PERB arbitrator (Debbie Murray-Sheppard). They think it is in the best interest if we negotiate with the City. Our lawyer feels as though our only course of action is to negotiate with the City and bring a 24/48 to the table with everything that we want for the shift.

If we go in with the mindset of 24/72 and continue to fight we will end up at PERB again with the City submitting the same LBFO only taking out the language of the Chief having sole discretion.  That language was the only reason we were able to move forward in Chancery Court. Without that language we have no real basis to move forward.

As much as I want to go back to the 24/72, today opened my eyes to how we are fighting a losing battle.  The City won’t stop using their unlimited resources to fight , but we are not are as fortunate.

My opinion is that we need to go in with a 24/48 and get our working hours as close 2080 hours as we can. That means:

1. another Kelly Day or a Kelly Day every 5 tours as opposed to 7 tours.

2. Time and half for anything over 40 hours

3. Time and half for all OT

4. Double time for Ordering OT

5. A pay scale that reflects what we actually work

6. Unlimited Exchange Days and the ability to stack       them. 

7. A pay increase across the board. 

Again only my opinion. The negotiating team will meet and start having discussions on how to move forward.
